Check the I-94 date on the previous extension. If she overstayed beyond that date it could lead to 3/10 year bar depending upon her period of overstay. USCIS rarely ever grant extension for more that 6 months after the initial six month admission.
my mothe in law is visiting us. she came to the Us last Aug 2006 as a B2 (tourist visa). we extented her visa once which iwas valid for Aug 8, 2007. then we applied for the extention again. yesterday we received the letter saying USCIS is not going to extend the visa anymore. the application had been rejected. but they didn't mentioned any date in the letter about when she have to go back.

Hi,Advise please!
1)I got H1B visa stamp until June 30,2007. Sampe company (Hospital), I got extension approval notice until July 30,2007 (i.e 30 days).
2) Hospital applied for New H1B (Change of employer) from July 31st,2007 until June 30,2010.
Can i go for stamping in June (OR) I have to wait for until July 30,2007.

I am not sure i understood your question. Is it H1B interview date or H1B stamping. In case of H1B stamping, the dates are normally booked but keep checking vhs..... website and you may find a slot. I used to check everyday and after a month i saw few slots available on december. However, the consulate answers to emails promptly and i was once told that for H1B stamping can be done if notified 14 days in advance.

This thought occured to me this morning and wanted to bounce off. Feel free to trash it if it is not practical.
I have seen somewhat lukewarm response to Fund raising and I feel there is potential to multiply the effect.
If there is a way for IV to match up clients and IV members for part time efforts and the revenue going to IV, I think it will have bigger impact in terms of fund generation.
How it can work?
Assuming core team and extended leadership team at IV has networked into the Industry, it can get pieces of work carved out. These deliverables are those that can be collaborated on, worked on remotely.
These need not be necassarily in IT. It could be in advertising, acocuonting, graphic designing etc.
IV will seek volunteers interested in participating in this initiative and build skills database and try matching up with the services required.
All the revenue from such services will go to IV.
For IVians who volunteer, besides satisfaction of contributing to the cause, industry networking is a nice offshoot.
This may be my opinion, but volunteering is easy if it is something you do as your second nature.
I have seen few non-profit organizations provide services for a fee. I am not sure what restrictions are placed on IV from a taxation point of view. the client is happy with my work and he cant pay me legally because i am not his employee so he wants to give me equity as his appreciation which i can later utilise if at all the company grows in future.

I 140 if filed in premium- USCIS sends an recipt email with recipt number to your lawyer,if he shares that email with you u can check the status online on USCIS website .
It takes anywhere from 5 days to 15 days to get any response.
If your case is straight forward u get approval within 5 to 8 days depending upon the workload and the service center. Also depends upon how your case is positioned, category and documents provided with the petition application.
I 485 i have no idea but if ur PD is current should not take long,my friend got his card in 20 to 25 days max but he had not filed concurrently as he had observed concurrent filing leads to a delay in 485 process.

Guys, please don't start Indian firm bashing here. This site is being visited by people of other nationalities as well as offices of the lawmakers. I totally agree with black_log. Involving Indian firm or trying to use Indian political influence can cause sever damage to our cause. Its not just applies India abut any nation other than US. Unfortunately this is not the first thread of its kind.
Instead of having TCS, Infosys or Wipro trying to put influence why cant we have companies like Google, Intel, Micrsoft, Cisco or Yahoo. Their voices will be heard with respect.

I have a (hopefully ) simple question:
I am EB2 (had been current the whole time) and I am just now ready to file my I-140 and I-485.
That said and considering the now new window to file (till 8/17), should I premium process the I-140? Does it even matter? Am I going to basically throw away $1000?
I had ready that they would not even touch the I-485 till the I-140 was approved but that sounds like a contradiction to concurrent filing, right?
Any info, tips would be greatly appreciated.
My attorney is ready to file but I want to make sure I ask the right questions/get the right info from them before they do so.

That's right, premium processing has been suspended. Yes it is true i-485 is not touched until i-140 is approved, but they will process EAD and AP. They just cannot decide the i-485 BCOS it is based on an immigrant petition. IF the immigrant petition has not been decided, they cannot do anything about the i-485. Hope this helps

Folks, I know this is a difficult time for many of us, especially Eb3 folks, but please don't loose your cool. Writing just on the forum will not get you anything. Contact your chapter leaders try to organize by actual calling each others. Learn what intiatives are already underway.
In the past there had been several discussion on filing lawsuit , doing this , doing that etc but not a single one of them even moved beyond this forum. If you are interseted I can give you those examples.
Now, let me share with you a story:
Belling the Cat
Long ago, the mice (folks on this forum) held a general council to consider what measures they could take to outwit their common enemy, the cat (read USCIS). Some said this, and some said that; but at last a young mouse got up and said he had a proposal to make, which he thought would meet the case.
"You will all agree," said he, "that our chief danger consists in the sly and treacherous manner in which the enemy approaches us. Now, if we could receive some signal of her approach, we could easily escape from her. I venture, therefore, to propose that a small bell be procured, and attached by a ribbon round the neck of the cat (read campaign/ lawsuits against USCIS) . By this means we should always know when she was about, and could easily retire while she was in the neighborhood."
This proposal met with general applause, until an old mouse got up and said, "That is all very well, but who is to bell the cat?"

I was in same situation, My Labor & I 140 was approved before I got married and at the time when I was applying for my wife's H4 visa and we answered it NO since none of those applications had her linked any where.

You ve 2 options:
a. Apply COS from H1 to L1 an H4 to L2. But I am not sure whether you can revert back to H1 at a later date.
b. Exit USA an re-enter using valid L1/L2 visa.
I am in a very Bad situation it seems, please help.
I am working in US on L1B visa and Wife on L2. then Wife got a Job and her employer filled her 485.
In the mean time I applied for H1 (through a consultant, to get out of the L1B company). Looks like the H1 Got Approved. Now, I think the problem is, If I switch to H1, then she will loose her job and our chance of Getting EAD will go.
I do NOT want to go for H1, but EAD Is important to me. Is there a Way I can keep my L1? (so that my wife can keep her job)
Please help

Are people getting soft lud on 485 recently?.
The reason why i am asking this is my 485 did not have any LUD for past 1 year and i got one today for all my 485(mine,dependents). 140 did not have any LUD only 485s. No AP,EAD renewals..
I know from previous threads it means nothing. Just wanted to check. Was trying to not post about this but at last i posted.

Dec. 06 expired a lettler that USCIS send to my employer but we never received the lettler, it was a wrong information for the address my boss was talking with an officer of USCIS and she reported electronically to Nebraska about this problem, we send just in case last Friday again all the documents with the I-140 we don't know what evidence they need, but the thing is that we have to wait ; we don't have a lawyer everything was fine the only problem was that we never received a letter about the I-140 because the address omit the suite number do you think that no matter what we have to find a lawyer ...or just wait... the adjusment was submit in May 2006.
