She definitely would have issues if plan to travel in TN visa. TN visa is not supposed to have any immigration intent.
The best thing to do is change her status to parolee and start working using EAD. There is no reason for her to continue in TN status, after filing 485.

My company attorney has mailed my I-140 application to NSC for premium processing on 12th october by priority mail. Waiting for receipt notice.
The amount of $1000 has been deducted but it has been through online banking and not the check, so there is no way yet to determine the case number. How many days does it usually take for NSC to issue a receipt notice? Is it quicker for PP cases?pls do reply.thanks.

No, It is now ROW, I am from India EB2. But as I said, they didn't make any decision. They still want to review the file and will get back to me in 120 days.

Hello,
Assuming a 40 hr/week position, a person works 2080 hours per year. The Annual Salary for a $46/hr position is $95680/year.
Also, if you only have annual salary for the new position, you could convert to hourly by dividing by 2080.
But I wouldn't even worry about all this. Just send in the annual salary figure (just for your own satisfaction make sure it is more than $46 per hour) and USCIS will figure out the rest.

These aren't anything special, but I'm dying to post something while I try to make up my mind about what to do about getting my transparencies into the computer.
All taken with a Kodak DX3500, but I've not figured out how to do my edits in Photoshop without destroying the EXIF. :confused:

And when you invoke AC21.. You must have EAD in hand...

Hi
I was not so so keen until this matter was resolved..BUT my GC got approved.
I am separated from spouse. But when I filed 485, I was "married" because our relationship was still unstable.
Now QUITE FRANKLY I am NOT sure what's going to happen ahead.Dont ask me why. This whole uncertainty depressed me . If I re-unite and my wife is in India and I am on GC HOW do I call her here ?
If I divorce and re-marry how do I get my new wife here.
In any case , I dont plan on getting more than 1 person so pl dont look at it from a gamers view.

My I-485 status is updated with the below message. LUD 05/21/2009. Surprisingly they mailed the document on 09 March 2009 and status update is on 05/21/2009

I entered exactly the following on a separate sheet for that item:
"Pending adjustment of status petition. Lengthy adjustment and the need to visit family from time to time."
I self filed for I-131 (both for my spouse and myself) and had no problem with the approval.

Dont waste your time for FOIA. You will never got it. I have personally applied for FOIA one and half year back and yet to see any response. I really doubt I will ever get a copy of I-140.
In fact I have not seen or heard of anyone getting I-140 copy based on FOIA. Everyone just said they applied or should get the copy someday; that's it. May be you should just go ahead and apply anyway. It has to negative effect but do not plan anything based on it. For example, you will change job after you get the copy or something like that than you will be waiting forever.

First, your international student adviser, should have notified you that your I-20 was about to expire. This is what USCIS requires them to do. Actually the SEVIS system automatically notifies IS advisers about I-20 expiring. Now, having said that, no, you cannot work. You need to apply for reinstatement and wait until it gets approved. Reinstatement into F-1 are very difficult as you need to show that you fell out of status because of circumstances beyond your control. You will probably need to argue that your adviser had failed to notify you and that you kept attending school and it was only a few days of out of status.

my GC is applied for future employment by company A on july2007.I did concurrent filing of 140 and 485.My I-140 approved on Feb 2008 and waiting for 485 approval. My PD belongs to 2005 mar EB2.
I am still working with my old company B .
My question is Am i eligible to change company C
without working for company A( My GC sponsored company).Can I file AC21 without working for GC sponsored company? Please i need somebody advice.

I have completed 4 years on H1B and I converted to L2 status and applied for EAD(feb'10) thru my Spouse's L1 Visa.
My GC is in process and not filed my I-485 yet.
Now my question is, as if i stay L2 for 1 year and if i convert it back to H1B, will my H1 term Start all over and will i get additional 6 year term? Please provide your feedback

i dont really know how but there is a way to do it
i think when u compile it(export, whatever) you need to check on option it has the word outline in it..hehe sorry i cant help more.
