You could use your current address to file and change your address later using form AR-11. However, after submitting the form you have to call USCIS customer service to effect the change of address on your outstanding cases. Alternatively if you change your address online through USCIS web site, you don't need to call customer service. But I'll advise that you call them anyway. Good luck.

Congressional Reply says that the applicant is pending completion of background check. Previous congressional reply was that the name check is completed.

The only option you have is to get into the U.S. and start working for the employer who sponsored your H-1B. After you establish that you work for the employer, you may start looking for another company, who can then do a transfer with H-1B extension for you, or you can ask your original employer to file extension of H-1B for you. In either case, you did not loose any of the 6 year time. The time starts counting after you enter U.S and are in H-1B status.

It was happenned to me also when I use my laptop which has Vista O/S. But when I tried in another system with windows XP , I did not find any problem.
I tried that too.I provided the petition details and clicked submit button. Then it takes me to save and exit buttons there is no continue button.
Let me try once again. Any more inputs.....

The thing that has to be remembered is that you have to mention is very clearly how you are availing the priority date and also quote the law.
File both the I-140 in the front. Put the argument all over the application. And dont forget to quote to law. Otherwise it will be returned back.
I think its possible but hire a very good lawyer to do it for you. Most of them dont know the law and dont even know how to handle such a case
There is a difference in tranferring the priority date and requesting to use an earlier application
First is when the second I-140 is going to be filed
Second is when you already have two I-140 and is planning to apply the 485
The first process is common and said to be proven. But the second is not very common.

Am trying to find out the relevant parts of HR 2892 that extends that benefit to EB cases.
Havent been able to find it?
Apart from Shusterman's commentary, I havent seen anything about the extension of benefits of the 'widow's penalty' to EB cases.
Maybe I am not looking at the right doc.
But those of you who have been able to see it in the statute/law, could you please point it out .....by sending the url, or noting the section/article of the law or any other way.

I would like to clarify one thing....
Are these Certifications from Sun Microsystems, Oracle and IBM consider as supporting documents for 4 year degree or equivalent to any educational qualifications or experience?
I mean, people are doing these certifications even with out a job or while on bench....
I do not want to degrade or project these certifications in low profile or so, I do know the value of these certifications while searching for a job, but could not understand how they will help you in education or experience with USCIS.
Correct me if I am wrong.....

I will be travelling to India for 3 week trip and will be coming back on Oct 12 ( My current AP expires on Oct 30 2008).
Since H1B visa stamp already expired on my passport , I would like to use my AP while reentry on Oct 12 at the port of entry .
Even though I have approved H1 B documents , expires on March 25 2009. But Iam not planning for HIB stamping due to my short trip
I have not used my EAD And I want continue be on H1 B status by applying extension of H1 B as soon as my arrival .
do you see and problem with this plan of REINSTATE MY HIB status by extension , since I would like to be on HIB status till I get my green card
My atty say go fo H1 stamping as H1 extention (REINSTATE MY HIB may need extenstive processing and apply status change from AOS to H1B visa
Iam with same employer for 6 years and continue with them till I have card in hand :)

I got my state labor approved and then it went to the San Francisco office in Dec 2004 and got it approved in June 2005. I am glad it didnt go to backlog center coz they were just starting up at the time.
Backlog centers have worsened the problem by slowing things down even further and now you even lost transparency. They are like "Trust us, we are the elite backlog centers...how could WE do anything wrong".

I bought the new Sigma 105 ex dg lens from b&h and it shipped today. I just couldn't bring myself to pay so much for the Nikon when every review of the sigma that I read said it was just as good. I should get the lens on Wednesday.

When I completed my online order, I got an email that I had to call to verify the order. When I did, the operator asked what camera I was using and then asked why I was buying a 35mm film lens for a digital camera.<o:p></o:p>

This caught me by surprise and also made me feel a bit stupid. I asked what the difference was and what he recommended. He then sent me to another page on his site that had the sigma lens for $850 on sale for $750. He then told me that there was a rebate for $150 and he could file it for me for a fee of $50. I told him that I'd file it myself and he offered to wave the $50 fee. He then said that shipping would take 2 weeks and when I balked, said that he would upgrade the shipping to 3 day. The standard shipping price was over $50 with insurance. My total price on the lens was just under $650. By that time, I would have paid anything.<o:p></o:p>

I searched their site and found the Sigma ex dg lens for sale elsewhere for $370. The search function on the site does not work correctly, so it was not easy. What a scam... They have their technique down to a science. I doubt that many people actually end up with what they originally ordered.
